Who we are
The operating name for this website and introduction service is Local Lead Tree. In these terms, “we”, “us” and “our” mean Local Lead Tree. “You” means the person using the website, requesting a quote, or applying to receive enquiries as a trade partner.
- Operating name: Local Lead Tree
- Contact: contact@localleadtree.co.uk
- Jurisdiction: England and Wales
Agreement to these terms
By using this website, requesting a quote, or submitting a trade partner enquiry, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site or send us an enquiry.
A separate written agreement may apply if you become a trade partner, including whether you buy enquiries on a pay-per-lead basis or pay an agreed percentage of jobs you convert. If that agreement conflicts with these terms, the written agreement applies to that commercial relationship. These terms still apply to use of the website.
Service user terms
If you ask for a quote, we introduce you to a trade partner for the trade and area you have requested. You do not have to accept any quote. Any contract for the work itself is between you and the trader you choose to instruct. We are not a party to that contract, and we do not carry out damp proofing, boiler repair, roofing, property maintenance or any other trade.
You agree that the details you give us are accurate, that you are asking for a quote for a genuine job, and that we may pass your name, phone number, postcode and requested trade to the trade partner who will quote. How we use that information is set out in the Privacy Policy.
You must not use the website to send unlawful, misleading or abusive material, to scrape or copy the site, or to interfere with how it operates.
Quote matching
We match an enquiry to a trade partner using the trade requested and the area covered. Matching is an introduction. It is not a recommendation that a particular trader is suitable for your property, and it is not a warranty of their work.
We do not guarantee:
- that a trade partner will respond, or how quickly they will respond
- that you will receive a quote, or any particular price, scope or availability
- the quality, safety, timing or outcome of any work a trader carries out
- that a trader holds any particular accreditation, insurance or licence, even where a trade normally requires one
Trade partners are independent businesses. Before you instruct anyone, check the written quote, ask about insurance, and make your own decision. Any complaint about the price or quality of the work should be raised with the trader who did it. You can also tell us at contact@localleadtree.co.uk if an introduction did not meet these terms.
Trade partner expectations
If you receive customer enquiries through Local Lead Tree, you agree to the following. We may pause or end introductions if you do not meet them.
- Respond to each enquiry promptly and deal with the customer in a professional way.
- Use the customer’s personal data only to quote for the service they requested and, if they agree, to carry out that work.
- Do not sell, rent, share or recycle a customer’s details, and do not add them to a marketing list for unrelated offers.
- Do not present yourself as Local Lead Tree, or present Local Lead Tree as the contractor doing the work.
- Hold the competence, and the insurance the job reasonably requires, for the trade you have told us you cover.
- Pay for enquiries on the performance basis we have agreed with you: either the pay-per-lead price, or the pre-agreed percentage of jobs you convert. There is no setup fee unless a separate written agreement says otherwise.
- Keep records that fairly show whether an introduced job was converted, where your commercial terms depend on conversion.
An enquiry is for the customer who asked for the quote. It is not a lead you may pass on to another business.
Intellectual property
The Local Lead Tree name, tree mark, website design, text and other content on this site are owned by us or used under licence. You may view the site for your own use of the service. You may not copy, republish or reuse the name, mark or site content for your own business without our written permission.
You keep ownership of the information you submit. You give us a non-exclusive licence to use that information so we can provide the introduction service, reply to you, and meet the obligations in these terms and the Privacy Policy.
Limitation of liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of England and Wales. If you are a consumer, your statutory rights are not affected, including rights under the Consumer Rights Act 2015.
We are not liable for the acts, omissions, quotes or work of independent trade partners, or for decisions you make after an introduction. We are not liable for loss of profit, loss of business, or other indirect or consequential loss arising from use of the website or from an introduction, except where the law does not allow us to exclude that loss.
Subject to the paragraph above, our total liability arising out of the website or an introduction is limited to the amount you paid us for the relevant enquiry in the 12 months before the claim. If you have not paid us, that cap is £100. Where a separate partner agreement sets a different cap for a commercial relationship, that agreement applies to claims under it.
Other terms
We may update these terms by posting a new version on this page. The version that applies is the one in force when you use the site or submit an enquiry. If a court finds that part of these terms is unenforceable, the rest continues to apply.
These terms, and any dispute about them or about the website, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that a consumer living in the United Kingdom may also bring a claim in the courts of the part of the UK in which they live, where the law gives them that right.
